Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and Vinyette, LLC (“Vinyette”, “we”, “us”), 121 S Broad St, 15th Fl #333, Philadelphia, PA 19107, United States. They cover the Vinyette website, app, shared Vinyettes, AI features, memory books, and any printed products you order. By creating an account or using Vinyette, you agree to these Terms. If you do not agree, please do not use Vinyette.
1. Who may use Vinyette
You must be at least 18 years old to create an account or make a purchase. By using Vinyette you confirm that you are 18 or older and able to enter into a binding contract. If you use Vinyette on behalf of a business (for example a hotel or property), you confirm you are authorised to bind that business to these Terms.
2. Your account
Keep your login details private and accurate, and tell us promptly at info@vinyette.com if you believe someone else has accessed your account. You are responsible for activity that happens under your account. You may close your account at any time from your settings.
3. Plans, credits and payments
- Vinyette offers a free plan, paid monthly subscriptions, one-time passes, and business plans. The current prices and what each plan includes are shown on our pricing page before you pay.
- Subscriptions renew automatically each billing period until you cancel. You can cancel at any time from your billing settings; cancellation takes effect at the end of the period you have already paid for.
- AI credits included with a plan reset each billing period and do not roll over. Passes apply only to the trip card and time window described at purchase.
- Payments are processed by our payment provider. We do not store your full card details. Taxes are added where required by law.
- Subscription fees already paid are non-refundable except where required by law or stated otherwise at purchase. Printed products are covered by section 6.
4. Your content — photos, memories and lists
Everything you upload or write — photos, captions, memories, itineraries, packing lists, messages — stays yours. You keep all ownership of it.
So that Vinyette can work, you give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, adapt, display and transmit your content for the purpose of running the service for you: showing your memories back to you and to the people you share a Vinyette with, creating watercolour artwork and maps, designing and printing your memory books, and sending your files to the print partner who fulfils your order. This licence lasts only as long as we need it to provide the service and ends when you delete the content or your account, apart from backups that expire on their normal schedule.
We do not sell your photos, and we do not use them in advertising or make them public without your permission.
You promise that, for everything you upload, you either own it or have permission to use it, and that it does not break the law or anyone else’s rights.
4.1 What we do with a photo you upload
- Store it. The original file is kept in our encrypted storage, linked to your account and to the Vinyette and card you added it to. We keep the full-resolution file so your printed book is sharp, and we create smaller copies for fast display.
- Display it. The photo is shown back to you in your Vinyette, and to the people you have invited to that Vinyette — no one else. Vinyettes are private by default; nothing you upload is published, listed publicly, or indexed by search engines. If you create a share link, anyone who has that link can see that Vinyette until you revoke it.
- Adapt it. We create derivatives needed for the product: cropped and resized versions, watercolour illustrations generated from your photo, map and cover artwork, and the print-ready book file.
- Send it to make your book. When you order, the finished book file is transmitted to our print partner solely to print and ship your order.
4.2 What we never do
We do not sell your photos, license them to anyone else, use them in advertising or marketing, publish them, or use them to train general-purpose AI models. We will not use a photo of yours to promote Vinyette unless you give us specific permission in writing first.
4.3 Removing a photo
- Deleting a photo in the app removes it from your Vinyette and from everyone you shared that Vinyette with straight away, and deletes the stored file and its derivatives.
- Copies held in encrypted backups expire on their normal schedule, within 90 days.
- Deleting your account removes all of your photos and content within 30 days, backups within 90 days.
- A photo already printed in a book that has been made or shipped cannot be recalled, and order records we must keep for tax purposes are covered by our Privacy Policy.
- You can also send a removal or deletion request through our privacy request form.
- If you appear in someone else’s photo on Vinyette and want it taken down, email info@vinyette.com and we will act on it.
The licence you give us in this section ends for a piece of content when you delete it or close your account, apart from those expiring backups.
5. Shared Vinyettes and other people in your photos
When you invite someone to a Vinyette, they can see and contribute to the content in it. Only invite people you trust with those memories, and only upload photos of other people where you have their agreement to do so. If someone appears in your photos and asks us to remove them, contact us and we will work with you to resolve it.
6. Printed books and physical products
- Printed books and other physical items are produced and shipped by third-party print partners. Delivery estimates are estimates, not guarantees.
- Because each book is made to order from your own photos and layout, orders cannot be changed or cancelled once printing has begun.
- If your order arrives damaged, misprinted, or materially different from what you approved, contact us within 30 days of delivery with photos and we will arrange a reprint or refund.
- Colour on a printed page will not exactly match a screen, and image sharpness depends on the resolution of the photos you upload. These are not defects.
7. AI features
Some features use AI to suggest plans, write text, and create illustrations and maps. AI output can be wrong, incomplete, or unsuitable — always check important details such as opening hours, prices, travel times, safety, visas and health requirements yourself. Vinyette is a planning and keepsake tool, not travel, legal, medical or financial advice.
8. Acceptable use
Please do not:
- upload unlawful, hateful, harassing, sexually explicit, or infringing content;
- upload images of children in any sexualised context — we report such material;
- try to break, overload, scrape, reverse engineer or gain unauthorised access to Vinyette;
- use Vinyette to send spam, or to impersonate someone else;
- resell or commercially redistribute the service without our written permission.
We may suspend or close accounts that break these rules, and remove content that does. Where it is reasonable to do so, we will tell you first.
9. Third-party services
Vinyette shows information and links from third parties such as maps, weather, and bookable experiences. Some links are affiliate links, which means we may earn a commission if you book. We do not control those services, their prices, or their availability, and your dealings with them are between you and them.
10. Our intellectual property
The Vinyette name, logo, crest, designs, book templates, and software are ours and are protected by law. You may use them only as part of using the service normally, including the books you order for yourself.
11. Availability and changes
We work to keep Vinyette running, but we do not guarantee uninterrupted service. Features may change, and we may add, alter or retire parts of the service. If a change is significant, we will tell you in advance where we reasonably can.
12. Disclaimers and liability
To the fullest extent allowed by law, Vinyette is provided “as is” without warranties of any kind. We are not liable for indirect, incidental, special or consequential losses, or for lost profits, lost data, or lost travel arrangements. Our total liability for any claim relating to Vinyette is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 100.
Nothing in these Terms limits liability that cannot be limited by law, including your legal rights as a consumer.
13. Ending the agreement
You may stop using Vinyette and delete your account at any time. We may end or suspend your access if you materially breach these Terms or if we stop offering the service. On closure we delete your content as described in our Privacy Policy, so please export anything you want to keep first.
14. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States federal law, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located in Philadelphia, Pennsylvania. If you live in the EU, UK, or another place whose law gives you the right to bring a claim locally, that right is unaffected.
15. Changes to these Terms
We may update these Terms. If the changes matter to you, we will notify you by email or in the app before they take effect. Continuing to use Vinyette after that means you accept the updated Terms.
